PARTICIPATION IN THIS RIDE AND/OR EVENT IS UNDERTAKEN STRICTLY AT THE PARTICIPATORS OWN RISK.

Participation in Katoke Trust for Overseas Aid Cycle Rides and Events carries risks of physical injury, misadventure, harm and/or death and also involves cycling on Public Roads which is a hazardous and dangerous activity. It requires a reasonable degree of physical stamina. As these factors cannot be eliminated, Katoke Trust for Overseas Aid cannot accept any responsibility whatsoever for any such physical or mental injury, misadventure, harm or death. Katoke Trust for Overseas Aid accepts no responsibility for the suitability of, or failure of, or defect of any equipment used, or any apparel used or worn by any participant, or for the actions or conduct of any participants. Katoke Trust for Overseas Aid accepts no responsibility for any warnings or advice given and/or issued for any circumstance by or on behalf of Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers.

Katoke Trust for Overseas Aid Cycle Rides – Waiver Clauses and Conditions Of Entry

All riders must read and agree to the following before joining the ride.

  1. In further consideration of my entry, I acknowledge that my participation in this ride or event is entirely at my own risk, and I do for myself, my executors,  administrators and assigns, at all times, now and hereafter make the following several releases :

In relation to death or personal injury to myself or to any other person (whether claiming through or against me or Katoke Trust for Overseas Aid and its organisers, sponsors, employees, servants, agents, volunteers and venue providers) I release, quit claim unto, indemnify, and hold harmless Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers from and against all claims for compensation, actions,  proceedings, suits, demands, costs, losses, and expenses howsoever incurred (whether or not , through the negligence, or breach of duty, by or on behalf of Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers) as a result of, or arising from my participation in this ride or event.
  3. In relation to loss and/or damage to property or pecuniary losses to myself or any other person (whether claiming through or against me or Katoke trust for Overseas Aid and its organisers, sponsors, employees, servants, agents, volunteers and venue providers) I release, quit claim unto, indemnify and hold harmless Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers from and against all claims for compensation, actions, proceedings, suits, demands, costs, losses and expenses howsoever incurred (whether or not through the negligence, or breach of duty, by or on behalf of Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers) as a result of, or arising from my participation in this ride or event.
  4. I acknowledge that I am fully responsible for all immediate and ongoing costs for treatment and/or associated services for Medical, Hospital and Ambulance requirements that may occur on my behalf, and that where required, Katoke Trust for Overseas Aid, its organisers, sponsors, employees, servants, agents, volunteers and venue providers may give consent on my behalf for Medical and/or Hospital treatment and/or associated services.
  5. I acknowledge that I am fully responsible for my own equipment and belongings (including vehicles and trailers) that I may bring on this ride, which may or may not be used during the ride and that I have considered insurance needs for myself and for my equipment and belongings (including vehicles and trailers).
  6. I agree to abide by all laws and road rules, and to follow any directions given by Police Officers, Ride Organisers and Ride Group Leaders.
  7. I agree to ride and drive safely at all times during this ride and to always participate as a team member with care and considerate behaviour for all other participants and all other road users.
  8. I declare that I have no known health conditions which may prevent me from participating in this ride. I also acknowledge that I am in a good physical and mental health condition and that I have the stamina in order to participate for the duration of this ride at the specified minimum average speed.
  9. I declare that I have sufficient bicycle riding experience and competence, and am fully aware of my responsibilities of the training and physical preparation required beforehand in order to participate in and complete this ride.
  10. I agree and fully understand that the Ride Organisers and Ride Group Leaders have the sole discretion, for any reason whatsoever to have me uplifted in a vehicle at any time during the this ride.
  11. I acknowledge and fully understand that this Katoke Trust for Overseas Aid Cycle Ride is not a race, but is a non competitive recreational cycle ride, and that I agree I will participate and follow instructions in this ride accordingly.
  12. I acknowledge and fully understand that Katoke Trust for Overseas Aid and its Ride Organisers have the sole discretion without reason, for the acceptance of me to participate in this ride, or to allow me to continue on during this ride, without refund.
  13. I declare that my bicycle and all parts on it are, in good order, and in a sound mechanical condition, and I agree that it will be professionally mechanically serviced no less than two weeks prior to the ride start.
  14. I acknowledge that drugs, alcohol, smoking and anti-social behaviour are not allowed during this ride, and the use of such things during this ride may result in my expulsion from the ride at the sole discretion of the Ride Organiser, without refund. Alcohol will be permitted once the ride has finished for the day – after a long day in the saddle you will have earned it.
  15. I acknowledge that this ride is a fundraising activity of Katoke Trust for Overseas Aid, and as such, I agree to to achieve the minimum suggested fundraising target of $200.00.
  16. I acknowledge that it is my own responsibility to ensure that I have whatever relevant private health and ambulance cover and insurance you feel is necessary regarding your health, medical, hospital, ambulance or any other issues and needs that personally and directly affect them for the duration of the ride.
